Summary of Chamber judgment Scavuzzo-Hager and Others v. Switzerland
The ECHR has on 7th February 2006 notified in writing its Chamber judgment in the case of Scavuzzo-Hager and Others v. Switzerland. The Court held unanimously: (1.) that there had been no violation of Article 2 of the Convention (right to life) on account of the use of force by police officers and the State´s obligation to protect the life of the applicants´ relative; (2.) that there had been a violation of Article 2 in that the Swiss authorities had not conducted an effective investigation into the circumstances of the death of the applicants´ relative; (3.) that there had been no violation of Article 3 (prohibition of inhuman or degrading treatment). Under Article 41 (just satisfaction), the Court awarded the applicants 12´000 euros (EUR) for non-pecuniary damage and EUR 9´500 for costs and expenses.
