Automated decisions, smart contracts and AI: is there really a «decision»?

Outside of the generally accepted public law notion, what really is a decision? Where is the line between a decision and predetermined choices without free will? Taking data protection automated decisions as an example, the author identifies the limits of the application of some clauses of the GDPR, Convention 108+ and the Swiss Federal Act on Data Protection in relation with smart contracts and AI. In explaining what decision-making machines really do, such as smart contracts and AI deep learning engine models, the author identifies the problem that arises upstream of the conditions of an ADM process: machines do not always make «decisions».
