Jurisdiction and e-commerce in Internet
A comparison between the U.S. and the Swiss approach to the problem
The borderless characteristics of the Internet compared to the traditional geographic notions of jurisdiction pose the following questions: does the law of personal jurisdiction apply to disputes arising out of electronic commerce over the Internet? If, yes how? The purpose of this paper is to answer this question, providing some examples on how issues concerning jurisdiction in Cyberspace are solved in U.S. and in Switzerland.
