WTO Law and Domestic Law: An Uneasy Relationship
The relationship of WTO law and domestic law is, from a domestic perspective, essentially a question of domestic constitutional law. But it is important to realize that more than legal and technical issues are involved in this relationship. There are no easy answers to the uneasy relationship between WTO law and domestic law. This paper seeks to address some of the issues of these complex relations by looking at the legal levels involved. First, the authors look at the international level. Second, they then turn to constitutional law and address in particular the problem of direct effect. Finally, they seek to lay out competing interests and address possible future steps.
