Osmosis of Anglo-Saxon Concepts in Swiss Business Law
In this article, the author takes us on a “tour d’ horizon” of different waves of influences on Swiss legal thinking. Terms such as “deregulation”, “put-options” or “money laundering” are in general use today, which is the most visible trace for the legal Osmosis of Anglo-Saxon – and more often American – legal concepts in Swiss Business law. Due to our special legislation process with the Federal Bureaucracy on one side and the masses of voting people on the other side, the protracted search for compromise often ends up in pragmatic, “watered-down” solutions, whenever we introduce legal concepts from abroad. According to the author, the result is a genuine “Swiss Müesli”.
