The Essential-Facilities-Doctrine in the USA, EU and Switzerland
With a special focus on FRAND
Die Essential-Facilities-Doctrine bezieht sich auf ein wettbewerbswidriges Verhalten, bei welchem eine Gesellschaft mit Marktmacht eine sog. Flaschenhals-Situation in einem bestimmten Markt ausnutzt, um Konkurrenten den Markteintritt zu verweigern. Der Autor gibt einen Überblick über die Essential-Facilities-Doctrine. Im Teil A wird die Essential-Facilities-Doctrine im Allgemeinen kurz erklärt und der Fokus auf einige offene und ungelöste Fragestellungen gelegt. Im Teil B werden ausgewählte Leitentscheide in den USA, der EU und der Schweiz besprochen. Im Teil C wird der Fokus auf das FRAND-Prinzip, welches u.a. in der EU-Kommission (vgl. etwa den Fall Qualcomm) ein umstrittenes Thema ist, sowie auf die Schiedsgerichtsbarkeit gelegt. Der Beitrag schliesst mit einer Konklusion und einem Ausblick.
