Compliance with Public Law Requirements in the Buyer’s Jurisdiction as a Seller’s Obligation under Art. 35 CISG?
Dans un contrat de vente internationale, la marchandise relève de deux législations différentes. Se pose dès lors la question de savoir à laquelle des deux, la marchandise doit satisfaire conformément à l’art. 35 CVIM. Les tribunaux ont souvent été appelés à trancher cette question, à commencer par le célèbre « cas des moules » de la Cour fédérale de justice allemande du 8 mars 1995. Même si cette décision peut avoir certains aspects d’un précédent, les décisions rendues ultérieurement ont plutôt été favorables à l’acheteur. Le but de ce travail consiste à déterminer à quelles conditions un vendeur est tenu de respecter la législation du pays de l’acheteur.
