Das Diskriminierungsverbot und die Beihilferegeln der World Trade Organization (WTO) haben einen erheblichen Einfluss auf die Ausgestaltung direkter Steuermassnahmen, welche den internationalen Handel mit Gütern und Dienstleistungen beeinträchtigen. Diese Regeln fokussieren insbesondere auf die fehlende Gleichbehandlung von inländischen, importierten und exportierten Waren. Aufgrund der Ungleichbehandlung von Inlands- und Exporttransaktionen verletzt der US-amerikanische Tax Cuts and Jobs Act von 2017 das allgemeine Zoll- und Handelsabkommen (GATT 1994) und die WTO-Regeln über Subventionen. Die Schweizerische Patentbox unterscheidet hingegen nicht zwischen Einkommen aus Inlands- und Exporttransaktionen; aufgrund deren Neutralität steht sie im Einklang mit den WTO-Regeln.
